The High Court today booted out Datin Seri Rosmah Mansor’s application to remove former Federal Court Judge Datuk Seri Gopal Sri Ram as the lead prosecutor in her corruption trial if she is not given a copy of his appointment letter.
High Court Judge Mohamad Zaini Mazlan ruled that Sri Ram’s appointment had been announced by the Attorney General and was public knowledge.
Rosmah had applied for Sri Ram to be removed as a Senior Deputy Public Prosecutor (DPP) after arguing that the prosecution must produce a copy of his letter of appointment to handle the case.
Her lawyers Datuk Jagjit Singh and Datuk Akberdin Abdul Kader argued that the prosecution’s failure must lead to Sri Ram’s disqualification from continuing as Senior DPP.

High Court Judge Mohamad Zaini Mazlan ruled that Sri Ram’s appointment had been announced by the Attorney General and was public knowledge.
“Sri Ram has appeared and led the prosecution of this case right from the start. The trial had entered its 19th day when the defence made this application.
“There is no reason for the defence to be given the letter of appointment and I therefore dismiss this application,” he said, adding his decision was also based on previous decided cases in the Court of Appeal and Federal Court.

Sri Ram has been acting as the lead DPP in the case since the start of the trial along with 10 other prosecutors from the Attorney General’s Chambers (AGC).
Rosmah’s lawyers argued that no document or letter of appointment had been advanced to the defence to confirm Sri Ram’s role.
They contended that in the absence of such a letter, the court must hold that Sri Ram was not a fit and proper person to act as DPP.
However, the prosecution had countered that Rosmah was embarking on a misconceived path and abusing the court process.
Deputy Public Prosecutor Ahmad Akram Gharib had countered that the defence application should not be entertained as there were settled law cases on the matter which clearly stated that the prosecution was not obliged to provide any such letter to the prosecution.
He had submitted that the prosecution was however prepared to provide Sri Ram’s letter of appointment for the court to look at.
Rosmah is on trial for soliciting RM187.5 million from Jepak Holdings Bhd to help the company secure a RM1.25 billion project to supply solar hybrid energy to 369 schools in the interior of Sarawak.
She is also accused of receiving RM5 million and another RM1.5 million in 2016 and 2017 respectively to ensure the company go the contract.
