Ismail Sabri failed to accomplish condition set by Agong, must resign by convention if Agong rejects dissolution request

The Yang Di-Pertuan Agong has discretionary powers to decide if the country is in a state of political Emergency and if the Proclamation of Emergency is necessary.

This was verified by lawyer Mohamed Haniff Khatri Abdulla, who explained, should Prime Minister Datuk Seri Ismail Sabri request for the dissolution of parliament, and should the Yang Di-Pertuan Agong say no, then, the Prime Minister must resign by convention.

Haniff also said the Yang Di-Pertuan Agong knows very well he will have to repeat the same process of appointing a new Prime Minister, for the third time in a single parliamentary term.

“Surely the Yang Di-Pertuan Agong will think, ‘don’t tell me I have to be held responsible for the political gluttony of political leaders, for the third time in the same 14th parliamentary term’?.

“These are factors that could cause the Yang Di-Pertuan Agong to declare a State of Emergency, simply because political instability cannot be allowed to become prevalent.”

“I believe that the consent to have a general election (soon) is the last thing on the Yang Di-Pertuan Agong’s mind.

“If (the request) is refused, then, there is a convention that requires (Datuk Seri) Ismail Sabri (Yaakob) to resign as Prime Minister.

“Now, whether or not he resigns as Prime Minister is a matter only Ismail Sabri can answer, because there was a bad example set around two years back, where Muhyiddin Yassin refused to resign when his first application for Emergency was rejected,” Haniff said.

The lawyer said this during a live session (click here to view or view video below article) to discuss the possibility of there being a general election or if the Yang Di-Pertuan Agong will declare a State of Political Emergency.

Haniff added, should Ismail Sabri not resign, there is a high possibility that UMNO and Datuk Seri Dr Ahmad Zahid Hamidi’s camp would continue to exert pressure on him, to the point that UMNO ministers may eventually retract their support for him.

“If that should happen, then, subtracting 20-plus from the 114 majority, Ismail Sabri will definitely fall.”

Haniff also said the support Pakatan Harapan has promised Ismail Sabri is irrelevant.

“This is all assumption, based on rumours. If UMNO withdraws its support, he (Ismail Sabri) will lose his majority.

“Ismail Sabri would then be required to seek an audience with the Yang Di-Pertuan Agong before Pakatan Harapan comes with its support.

“When he has an audience with the Yang Di-Pertuan Agong, he will be required to tender his resignation pursuant to Article 43(4) (of the Federal Constitution of Malaysia), not run around seeking support.

“If that were to happen, wouldn’t the state of political instability worsen, (particularly) during the monsoon season? This is in the mind of the Yang Di-Pertuan Agong. “

Haniff said the Yang Di-Pertuan Agong knows very well he will have to repeat the same process of appointing a new Prime Minister, for the third time in a single parliamentary term.

“Surely the Yang Di-Pertuan Agong will think, ‘don’t tell me I have to be held responsible for the political gluttony of political leaders, for the third time in the same 14th parliamentary term’?.

“And if Ismail Sabri himself has demonstrated that he lacks the ability to stop the top leadership of his own party, then, I believe that the Yang Di-Pertuan Agong already has and should have plans and strategies for a decision that can stop political instability.

“After all, that (to stabilise politics) was also the condition upon which the Yang Di-Pertuan Agong appointed Ismail Sabri, which Ismail Sabri failed to accomplish.”

Haniff said this referring to the fact, that before appointing Ismail Sabri as Prime Minister, the Yang Di-Pertuan Agong made it a condition that the new Prime Minister must be able to stabilise the country’s politics.
