Penang DAP today claimed that the Malaysian Anti-Corruption Commission (MACC) had investigated the Penang undersea tunnel project since 2017 and found no wrongdoing.
In a press statement dated the 1st of July 2020, it said the anti-graft agency had issued a letter to the company involved, Consortium Zenith Construction (CZC), in November 2018 to confirm that investigations had ended and there would be no further charges.
Penang DAP also alleged that Raja Petra Kamaruddin (RPK) had posted fake documents with unfounded allegations on the case, adding that the MACC lodged a police report against RPK on the matter.
However, it now seems the MACC may be after others besides Zenith, as a source close to the investigation revealed that the agency would summon several state executive council members and officials from the Seberang Perai City Council for questioning.
PETALING JAYA: Penang DAP today claimed that the Malaysian Anti-Corruption Commission (MACC) had investigated the Penang undersea tunnel project since 2017 and found no wrongdoing.
In a press statement dated the 1st of July 2020, it said the anti-graft agency had issued a letter to the company involved, Consortium Zenith Construction (CZC), in November 2018 to confirm that investigations had ended and there would be no further charges.
The existence of the letter was made known on the 18th of March 2020 during a press conference by Chow Kon Yeow.
According to him, the MACC had sent a letter to Zenith and another to the company’s senior executive director, Datuk Zarul Ahmad Mohd Zulkifli.
Chow claimed that both Zenith and Zarul were told in the letter that no further action would be taken against them.
Penang DAP also alleged that Raja Petra Kamaruddin (RPK) had posted fake documents with unfounded allegations on the case, adding that the MACC lodged a police report against RPK on the matter.
The DAP also highlighted the fact that Lim Guan Eng won his defamation suit against RPK at High Court on the same issue due to RPK’s failure to show up.
It has been said that the project was an excuse to ‘legalise’ the handover of land as ‘payment’ to a Special Purpose Vehicle (SPV) awarded the project. It cannot be denied that the award broke multiple procurement laws.
The project raised alarm when a Chinese state-owned firm which the Penang government insisted held stakes in the project was found never to have had those stakes and was merely the main contractor.
It was later discovered that the construction firm – China Railway Construction Corporation Ltd (CRCC) – was forced to stop work as it had received only 5% (or a little over RM3mil) of the RM69mil value contracted since the project was first awarded to the SPV in 2013.
That immediately brought into question delays by the parent company overlooking the SPV, Zenith Consortium, in paying CRCC more money.
This is considering that the consortium had already received 5.67 acres of state land worth RM208 million and commenced luxury highrise projects worth RM800 million on a chunk of that land.
If what Chow told the people about the letters issued by the MACC to Zenith is true, it means the anti-graft agency found no reason to implicate Zenith or its CEO of wrongdoing.
However, it now seems the MACC may be after others besides Zenith, as a source close to the investigation revealed that the agency would summon several state executive council members and officials from the Seberang Perai City Council for questioning.
The matter was revealed by FMT, which also quoted the source as saying that the tunnel case was never closed.
“We have received new leads which necessitated the need to question the witnesses again,” the source reportedly said.
